ศาลสั่งลงโทษหนัก จำคุก 25 ปี 3 เดือน ผู้ต้องหาคดีลอบยิงตำรวจหน่วยปฏิบัติการพิเศษ สุไหงโก-ลก ชี้เป็นการกระทำอุกอาจต่อเจ้าหน้าที่รัฐ

          จากกรณีเหตุการณ์ เมื่อวันที่ 16 กรกฎาคม 2565 เวลาประมาณ 01.40 น. ได้มีคนร้ายจำนวน 2 คน ขับขี่รถจักรยานยนต์และได้ใช้อาวุธปืนประกบยิงเจ้าหน้าที่ตำรวจ ในพื้นที่ อำเภอสุไหงโก-ลก จังหวัดนราธิวาส ขณะขี่รถจักรยานยนต์บนถนนทรายทอง 5 เขตเทศบาลเมืองสุไหงโก-ลก เพื่อไปปฏิบัติหน้าที่ ณ ด่านจุดตรวจบ้านน้ำตก ภายหลังเกิดเหตุเจ้าหน้าที่ได้เข้าตรวจสอบพื้นที่ ตรวจพบรถจักรยายนต์ยี่ห้อ ฮอนด้า เวฟ 110 ไอ ทะเบียน 1 กก 4447 ยะลา ล้มลงอยู่บริเวณกลางถนน ส่วนผู้ถูกยิง ทราบชื่อ สิบตำรวจตรี ธนกฤต  ฤกษ์ดี อายุ 23 ปี ตำแหน่ง ผู้บังคับหมู่ หน่วยปฏิบัติการพิเศษ สถานีตำรวจภูธรสุไหงโก-ลก จังหวัดนราธิวาส ต่อมาได้เสียชีวิตระหว่างนำตัวส่งโรงพยาบาลสุไหงโก-ลก จากนั้นเจ้าหน้าที่เก็บรวบรวมวัตถุพยานและหลักฐานต่าง ๆ ในที่เกิดเหตุ จนกระทั่งสามารถขยายผลนำไปสู่การจับกุมตัวคนร้ายได้ จึงส่งตัวเข้าสู่กระบวนการยุติธรรมเพื่อดำเนินกรรมวิธีในส่วนที่เกี่ยวข้องต่อไป

          กระทั่งเมื่อวันที่ 15 ธันวาคม 2565 ศาลจังหวัดนราธิวาส พิพากษา “จำคุกตลอดชีวิต” นายฮาฟิส (สงวนนามสกุล) จำเลย ความผิดฐาน ก่อการร้าย ซ่องโจร ความผิดต่อชีวิต ทำให้เสียทรัพย์ พ.ร.บ.อาวุธปืนและวัตถุระเบิดฯ เนื่องจากโจทก์มีพยานหลักฐานที่มีน้ำหนักพอ อีกทั้งจำเลยให้การรับสารภาพในชั้นดำเนินกรรมวิธีซักถาม ว่าเป็นผู้ร่วมก่อเหตุยิงเจ้าหน้าที่ตำรวจในคดีนี้ ลงโทษจำเลยทุกกระทงความผิดที่โจทก์ฟ้อง เมื่อรวมความผิดทุกกระทงแล้วจำเลยจึงต้องรับโทษบทหนักสุดคือ ร่วมกันก่อการร้ายโดยใช้กำลังประทุษร้ายให้ลงโทษประหารชีวิต คำให้การของจำเลยเป็นประโยชน์ ต่อการพิจารณาลดโทษกระทงละกึ่งหนึ่ง คงเหลือจำคุกตลอดชีวิต (อ.914/66)

          และต่อมาเมื่อวันที่ 26 กันยายน 2567 ศาลจังหวัดนราธิวาสอ่านคำพิพากษาศาลอุทธรณ์ ภาค 9 พิพากษา แก้ “จำคุกตลอดชีวิต” นายฮาฟิส (สงวนนามสกุล) จำเลย ความผิดฐาน ก่อการร้ายโดยใช้กำลังประทุษร้าย ซ่องโจร ความผิดต่อชีวิต ทำให้เสียทรัพย์ พ.ร.บ.อาวุธปืนและวัตถุระเบิดฯ เนื่องจากโจทก์มีพยานหลักฐานที่มีน้ำหนักพอ อีกทั้งจำเลยให้การรับสารภาพในชั้นดำเนินกรรมวิธีซักถามว่าเป็นผู้ร่วมก่อเหตุยิงเจ้าหน้าที่ตำรวจในคดีนี้ ลงโทษจำเลยทุกกระทงความผิดที่โจทก์ฟ้อง เมื่อรวมความผิดทุกกระทงแล้วจำเลยจึงต้องรับโทษบทหนักสุดคือ ร่วมกันก่อการร้ายโดยใช้กำลังประทุษร้ายให้ลงโทษจำคุกตลอดชีวิต คำให้การของจำเลยเป็นประโยชน์ต่อการพิจารณา ลดโทษกึ่งหนึ่ง คงเหลือ จำคุก 25 ปี 3 เดือน และ ปรับ 500 บาท (อ.914/66)

Mahkamah menjatuhkan hukuman berat penjara selama 25 tahun 3 bulan terhadap tertuduh kes tembak anggota polis unit operasi khas Su-ngai Kolok. Keputusan ini menunjukkan bahawa tindakan tersebut merupakan jenayah serius terhadap pegawai awam.

          Kejadian berlaku pada 16 Julai 2022 sekitar jam 01.40 pagi, di mana dua suspek menaiki motosikal dan menembak anggota polis di kawasan daerah Su-ngai Kolok, Narathiwat ketika beliau sedang menunggang motosikal di jalan Sai Thong 5 di bawah pentadbiran Majlis Bandaraya Su-ngai Kolok, dalam perjalanan untuk bertugas di pos pemeriksaan Ban Nam Tok. Selepas kejadian, pihak berkuasa mendapati motosikal Honda Wave 110I bernombor pendaftaran 1 KG 4447 Yala terbaring di tengah jalan. Mangsa dikenali sebagai Sarjan Pol Tanakrit Rukdee, berusia 23 tahun, pegawai Unit Operasi Khas dari Balai Polis Su-ngai Kolok, Narathiwat, yang meninggal dunia semasa dalam perjalanan ke Hospital Su-ngai Kolok. Pihak berkuasa kemudian menjalankan siasatan dan berjaya menangkap suspek yang terlibat dalam kejadian tersebut.

          Pada 15 Disember 2022, Mahkamah Daerah Narathiwat menjatuhkan hukuman penjara seumur hidup terhadap Hafis (nama samaran) kerana kesalahan terlibat dalam aktiviti keganasan, penyertaan dalam kumpulan jenayah, membunuh, merosakkan harta benda, dan pelanggaran Akta Senjata Api dan Bahan Letupan. Tertuduh mengaku bersalah semasa soal siasat, dan dijatuhi hukuman maksimum iaitu hukuman mati, namun kerana kerjasama beliau semasa siasatan, hukuman dikurangkan kepada penjara seumur hidup.

          Kemudian, pada 26 September 2024, Mahkamah Rayuan 9 mengubah hukuman kepada penjara 25 tahun 3 bulan dan denda 500 Baht. Tertuduh dijatuhkan hukuman berdasarkan semua kesalahan yang dibuktikan, namun diberi pengurangan hukuman berdasarkan kerjasama dalam proses perbicaraan (A.914/66).

The court imposes a heavy sentence of 25 years and 3 months imprisonment on the suspect in the case of the ambush shooting of a special operations police officer in Su-ngai Kolok, ruling it as an egregious act against a public official.

          The incident occurred on July 16, 2022, around 1:40 AM, when two assailants riding a motorcycle ambushed and shot a police officer in the Su-ngai Kolok district, Narathiwat. The officer was riding a motorcycle on Sai Thong 5 Road, within the Su-ngai Kolok Municipality, on his way to perform duties at the Ban Nam Tok checkpoint. After the incident, authorities inspected the scene and found a Honda Wave 110i motorcycle, with the license plate 1 KG 4447 Yala, lying in the middle of the road. The victim, identified as Sergeant Major Thanakrit Rukdee, aged 23, was a commanding officer of the Special Operations Unit at Su-ngai Kolok Police Station. He later died while being transported to Su-ngai Kolok Hospital. Authorities gathered evidence at the crime scene, which eventually led to the arrest of the perpetrators. The case was then processed through the legal system.

          On December 15, 2022, the Narathiwat Provincial Court sentenced Hafis (surname withheld) to life imprisonment for crimes including terrorism, involvement in a criminal gang, homicide, property damage, and violations of the Firearms and Explosives Act. The prosecution presented compelling evidence, and the defendant confessed during questioning, admitting to being involved in the shooting of the police officer. The court convicted the defendant on all charges. Given the severity of the charges, the defendant faced the harshest penalty: death by capital punishment. However, due to the defendant’s cooperation during the investigation, the sentence was reduced to life imprisonment.

          On September 26, 2024, the Narathiwat Provincial Court of Appeals amended the sentence to life imprisonment. Hafis was convicted for terrorism using force, criminal gang participation, homicide, property damage, and firearms violations. The court found the evidence strong, and the defendant again confessed to the crime. His cooperation during the investigation led to a reduction in his sentence by half. The final sentence was 25 years and 3 months imprisonment, along with a 500 Baht fine. (Case No. A.914/66)
