ศาลฎีกาพิพากษา “จำคุก 2 ปี 16 เดือน” กรณีมีส่วนเกี่ยวข้องกับการก่อการร้ายและเป็นอั้งยี่

          เมื่อวันที่ 13 สิงหาคม 2568 ศาลฎีกา จังหวัดนราธิวาส มีคำพิพากษา “จำคุก 2 ปี 16 เดือน” นายฟารุดดีน (สงวนนามสกุล) จำเลยความผิดฐานร่วมกันสะสมกำลังพลเพื่อก่อการร้ายฯ, อั้งยี่ จากเหตุการณ์เมื่อวันที่ 10 มีนาคม 2564 คนร้ายใช้อาวุธปืนลอบยิง อส.มูฮำมัดซับรี  สาและ อายุ 45 ปี เป็นสมาชิกกองอาสารักษาดินแดน อำเภอบาเจาะ กระสุนปืนถูกเข้าที่ศีรษะและร่างกายหลายนัด จนทำให้เสียชีวิตในที่เกิดเหตุ

         ต่อมา ศาลฎีกา พิพากษา “แก้คำพิพากษา” ศาลอุทธรณ์ ของ นายฟารุดดีน (สงวนนามสกุล) จำเลยความผิดฐานร่วมกันสะสมกำลังพลเพื่อก่อการร้ายฯ, อั้งยี่ จาก “จำคุก 8 เดือน” เป็น “จำคุก 5 ปี” ฐานร่วมกันสะสมกำลังพลหรืออาวุธ จัดหาหรือรวบรวมทรัพย์สินหรือสมคบกัน เพื่อก่อการร้ายหรือกระทำความผิดใด ๆ อันเป็นส่วนของแผนการเพื่อก่อการร้าย “จำคุก 4 ปี” ฐานเป็นอั้งยี่ “จำคุก 1 ปี” เนื่องจากคำให้การในชั้นดำเนินกรรมวิธีซักถามชั้นสอบสวนและในชั้นพิจารณาของจำเลยเป็นประโยชน์แก่การพิจารณามีเหตุ “บรรเทาโทษลดโทษให้กระทงละหนึ่งในสาม” ตามประมวลกฎหมายอาญา มาตรา 78 ฐานร่วมกันสะสมกำลังพลหรืออาวุธ จัดหา หรือรวบรวมทรัพย์สินหรือสมคบกันเพื่อก่อการร้ายหรือกระทำความผิดใด ๆ อันเป็นส่วนของแผนการเพื่อก่อการร้าย คง “จำคุก 2 ปี 8 เดือน” และฐานเป็นอั้งยี่ คง “จำคุก 8 เดือน” รวมเป็น จำคุก 2 ปี 16 เดือน (คดีถึงที่สุด จำคุกจำเลยตามคำพิพากษาศาลฎีกา)

         โดยกฎหมายของคำว่า “อั้งยี่” หมายถึง การรวมตัวกันเป็นกลุ่มลับอย่างผิดกฎหมาย มีเป้าหมายเพื่อทำสิ่งไม่ดี เช่น วางแผนก่อเหตุร้าย หรือก่อความเหตุความรุนแรง ซึ่งการสนับสนุนการก่อการร้าย ไม่จำเป็นต้องลงมือเอง แต่ ถ้าร่วมจัดหาอาวุธ คน หรือเงินทุน เพื่อสนับสนุน ก็มีความผิดตามกฎหมาย ส่วน “การลดโทษในศาล” มีได้ถ้าผู้ต้องหาให้ความร่วมมือ เช่น ยอมรับผิด หรือให้ข้อมูลที่เป็นประโยชน์ต่อกระบวนการยุติธรรม

         กองอำนวยการรักษาความมั่นคงภายในภาค 4 ส่วนหน้า ขอความร่วมมือพี่น้องประชาชน หากพบบุคคลต้องสงสัยเข้ามาเคลื่อนไหวในพื้นที่ สามารถแจ้งได้ที่หมายเลขโทรศัพท์สายตรง แม่ทัพภาคที่ 4 / ผู้อำนวยการรักษาความมั่นคงภายในภาค 4 โทร 061-1732999 หรือเบอร์สายด่วน กอ.รมน.ภาค 4 สน. 1341 และหน่วยเฉพาะกิจในพื้นที่ได้ตลอด 24 ชั่วโมง รวมทั้งขอเรียนให้ทราบว่าผู้ให้การสนับสนุนผู้กระทำผิดด้วยวิธีการต่างๆ เช่น การนำพาซ่อนเร้น การให้การสนับสนุนที่พักพิง หรือการสนับสนุนเสบียงอาหาร จะมีความผิดตามประมวลกฎหมายอาญา มาตรา 189 ต้องระวางโทษจำคุกไม่เกิน 2 ปี หรือปรับไม่เกิน 40,000 บาท หรือทั้งจำทั้งปรับ “อย่าหลงเชื่อ หรือร่วมมือกับกลุ่มผู้ก่อเหตุรุนแรง หรือผู้ที่ชักชวนให้เข้าร่วมขบวนการก่อเหตุรุนแรง เพราะกฎหมายไม่ละเว้นผู้ที่เกี่ยวข้องกับการก่อเหตุความรุนแรง แม้จะไม่ได้ลงมือเอง หากร่วมวางแผน หรือสนับสนุนในทางใดก็ตาม ก็มีโทษจำคุกได้เช่นกัน”

  Mahkamah Agung jatuhkan hukuman penjara 2 tahun 16 bulan atas kesalahan berkait dengan kegiatan keganasan dan jadi ahli kumpulan haram (angyee).

  Pada 13 Ogos 2025, Mahkamah Agung di Wilayah Narathiwat telah jatuhkan hukuman penjara 2 tahun 16 bulan kepada Encik Faruddin (nama disimpan) atas kesalahan terlibat dalam kumpulan yang merancang keganasan dan jadi ahli kumpulan haram (angyee).

Kes ini berkaitan dengan kejadian pada 10 Mac 2021, di mana penyerang bersenjata telah tembak mati Askar Sukarelawan Muhammad Sabri Sala, umur 45 tahun, di daerah Bajoh. Mangsa ditembak di kepala dan badan beberapa kali dan meninggal di tempat kejadian.

  Mahkamah Agung telah ubah keputusan Mahkamah Rayuan dari hukuman penjara 8 bulan kepada 5 tahun, kerana:

4 tahun penjara atas kesalahan rancang, kumpul orang, senjata atau wang untuk tujuan keganasan

1 tahun penjara atas kesalahan jadi ahli kumpulan haram (angyee)

Tetapi kerana tertuduh beri kerjasama semasa soal siasat dan perbicaraan, mahkamah kurangkan hukuman 1/3, jadi:

2 tahun 8 bulan atas kesalahan rancang keganasan

8 bulan atas kesalahan jadi ahli angyee

Jumlah: 2 tahun 16 bulan penjara

  Dalam undang-undang, maksud “angyee” ialah kumpulan rahsia yang haram, yang mungkin merancang buat jahat atau keganasan.

Sesiapa yang bantu kumpulan keganasan – walaupun tidak buat sendiri – tapi kalau sediakan senjata, tempat tinggal, duit, atau sembunyikan orang, tetap bersalah di sisi undang-undang.

Kalau orang yang dituduh mengaku salah atau bantu pihak berkuasa dengan maklumat, mahkamah boleh kurangkan hukuman.

kalau nampak orang asing atau orang mencurigakan datang buat gerakan di kampung, tolong lapor ke:

  Sesiapa yang bantu penjenayah – seperti sembunyikan, bagi tempat tidur, atau sediakan makanan – boleh dikenakan hukuman penjara tak lebih 2 tahun atau denda tak lebih 40,000 Baht, atau kedua-duanya sekali (ikut Seksyen 189 Kanun Jenayah Thai).

  Jangan percaya atau ikut kumpulan yang ajak buat keganasan. Undang-undang tetap hukum walaupun tak buat sendiri – kalau bantu rancang atau sokong, tetap salah.

  Supreme Court Sentences Individual to 2 Years and 16 Months Imprisonment for Involvement in Terrorism and Membership in a Secret Society

  On August 13, 2025, the Supreme Court of Narathiwat Province rendered a final verdict sentencing Mr. Faruddin (surname withheld) to 2 years and 16 months of imprisonment on charges of conspiring to assemble manpower for the purpose of terrorism and involvement in a secret society (Ang Yi).

The charges stem from an incident on March 10, 2021, in which an armed assailant fatally shot Volunteer Territorial Defense Officer Muhammad Sabri Sala, aged 45, a member of the Volunteer Defense Corps in Bacho District. The victim sustained multiple gunshot wounds to the head and body and died at the scene.

  The Supreme Court later revised the decision of the Court of Appeal, increasing Mr. Faruddin’s sentence from 8 months to 5 years as follows:

4 years for conspiring to gather manpower, weapons, or financial resources in support of terrorism or in connection with a terrorist plan, and

1 year for being a member of a secret society (Ang Yi).

However, due to the defendant’s cooperation during interrogation and trial, the court applied a reduction of one-third of the sentence per charge in accordance with Section 78 of the Thai Penal Code, resulting in:

2 years and 8 months for terrorism-related conspiracy

8 months for membership in a secret society

Thus, the total sentence stands at 2 years and 16 months imprisonment, as ruled by the Supreme Court. The case is now final and enforceable.

  Under Thai law, “Ang Yi” refers to a secret society or unlawful association formed with the intention of committing illegal acts, such as plotting or inciting violence.

Support for terrorism does not require direct participation in violent acts; those who assist by providing weapons, manpower, financial support, or shelter are also criminally liable.

A reduction in sentencing may be granted by the court if the accused cooperates, pleads guilty, or provides valuable information to the judicial process.

Furthermore, the public is reminded that providing support to offenders—such as hiding them, offering shelter, or supplying food—constitutes an offense under Section 189 of the Thai Penal Code, punishable by up to 2 years imprisonment, a fine not exceeding THB 40,000, or both.

  Do not be misled or cooperate with individuals or groups involved in violent acts or who seek to recruit others into such activities.

The law does not exempt anyone involved in violent incidents. Even if one does not directly commit the act, participating in planning or providing any form of support is punishable by law.
