ศาลชั้นต้น สั่งจำคุก 35 ปี 8 เดือน มือปืนซุ่มยิงเจ้าหน้าที่ตำรวจ บนเทือกเขายือราแป อ.รือเสาะ จ.นราธิวาส

          เหตุการณ์เมื่อวันที่ 31 สิงหาคม 2563 มีกลุ่มคนร้ายไม่ต่ำกว่า 10 คน ใช้อาวุธปืนสงครามซุ่มยิงรถยนต์หุ้มเกราะเจ้าหน้าที่ตำรวจ สถานีตำรวจภูธรเมืองนราธิวาส บริเวณเส้นทางลัดบนเทือกเขายือราแป เขตรอยต่อระหว่างบ้านยือราแป ตำบลสุวารี อำเภอรือเสาะ จังหวัดนราธิวาส ขณะเดินทางกลับจากการประชุมที่ศูนย์ปฏิบัติการตำรวจส่วนหน้า เป็นเหตุให้เจ้าหน้าที่ตำรวจได้รับบาดเจ็บ จำนวน 3 ราย และรถยนต์หุ้มเกราะได้รับความเสียหาย ภายหลังเกิดเหตุเจ้าหน้าที่ได้เข้าทำการปิดกั้นเส้นทางและควบคุมพื้นที่ รวบรวมวัตถุพยานและหลักฐานต่างๆ ในที่เกิดเหตุ จนกระทั่งนำไปสู่การติดตามจับกุมคนร้ายมาดำเนินคดีตามกฎหมายได้ในที่สุด

          กระทั่งเมื่อวันที่ 8 พฤศจิกายน 2566 ศาลจังหวัดนราธิวาส (ชั้นต้น) พิพากษา จำคุก 35 ปี 8 เดือน นายอามีร  (สงวนนามสกุล) จำเลย ความผิดฐานพยายามฆ่าเจ้าพนักงานฯ เนื่องจากศาลเชื่อคำรับสารภาพของจำเลย    แม้เป็นแค่เพียงพยานบอกเล่าแต่เมื่อพิเคราะห์แล้วสามารถรับฟังได้ว่า จำเลยคือคนร้ายที่ร่วมก่อเหตุในคดีนี้ เพราะจำเลยสามารถชี้จุดและลำดับขั้นตอนเป็นอย่างดี และการสอบสวน มีทั้งทนายความและบุคคลที่จำเลยไว้ใจ คือ มารดา และภริยาของจำเลย มาร่วมสอบสวน โดยจำเลยลงชื่อในคำรับสารภาพโดยความสมัครใจ    (ขังจำเลยระหว่างอุทธรณ์ อ.543/66 นับโทษต่อจากคดีเดิมที่ศาลมีคำพิพากษาจำคุก 35 ปี 12 เดือน จำเลย)

Mahkamah Rendah mengarahkan hukuman penjara selama 35 tahun 8 bulan terhadap penembak yang menyasarkan anggota polis di Gunung Yerapah, Daerah Rusoh, Narathiwat.

Kejadian berlaku pada 31 Ogos 2020, di mana sekumpulan lebih dari 10 orang penyerang menggunakan senjata api tentera untuk menyerang kenderaan perisai anggota polis dari Ibu Pejabat Polis Daerah Narathiwat. Kejadian berlaku di laluan pintas di Gunung Yerapah, sempadan antara Kampung Yerapah, Kampung Suwaree, Daerah Rusoh, Narathiwat, ketika anggota polis itu dalam perjalanan pulang dari mesyuarat di Pusat Operasi Polis Hadapan. Serangan itu mengakibatkan tiga anggota polis cedera dan kenderaan perisai rosak. Selepas kejadian, pihak berkuasa telah menutup laluan dan mengawal kawasan kejadian untuk mengumpul bukti, yang akhirnya membawa kepada penangkapan penyerang untuk dihadapkan ke muka pengadilan.

Pada 8 November 2023, Mahkamah Negeri Narathiwat (Peringkat Rendah) menjatuhkan hukuman penjara 35 tahun 8 bulan kepada Amir (nama keluarga dirahsiakan), tertuduh yang disabitkan dengan cubaan membunuh pegawai awam. Mahkamah menerima pengakuan tertuduh walaupun ianya hanya berdasarkan keterangan saksi, namun pengakuan tersebut boleh diterima kerana tertuduh dapat menunjukkan lokasi dan kronologi kejadian dengan jelas. Selain itu, proses soal siasat dilakukan bersama peguam dan individu yang dipercayai oleh tertuduh, iaitu ibu dan isterinya. Tertuduh menandatangani pengakuan dengan sukarela. (Tertuduh ditahan sementara menunggu rayuan, dengan hukuman yang dijatuhkan pada kes terdahulu yang merupakan penjara selama 35 tahun 12 bulan.)

The Lower Court sentenced a gunman to 35 years and 8 months in prison for ambushing and shooting at police officers in the Yerapah mountain range, Rusoh District, Narathiwat Province.

The incident occurred on August 31, 2020, when a group of at least 10 armed assailants used military-grade firearms to ambush a police armored vehicle from the Narathiwat Provincial Police Station. After careful consideration, the court found that the defendant was involved in the crime, as he could accurately point out the locations and steps of the incident. The investigation was conducted with the involvement of the defendant’s trusted individuals, including his mother and wife, and the defendant signed his confession voluntarily. (The defendant is being held in custody during the appeal, with the sentence to be served after the original case in which the defendant was sentenced to 35 years and 12 months in prison.)
