ศาลชั้นต้นยะลา พิพากษา “จำคุกตลอดชีวิต” มือยิงครอบครัว อส.ฮากีมฯ พื้นที่บ้านบันนังกูแว อ.บันนังสตา ปี 57

          จากกรณีเหตุการณ์เมื่อวันที่ 20 เมษายน 2557 เกิดเหตุคนร้ายลอบยิงสมาชิกในครอบครัวของ สมาชิกกองอาสารักษาดินแดน ฮากีม ดาราเซะ เสียชีวิต 3 ราย และได้บาดเจ็บ 1 ราย เหตุเกิดบนนถนนสาย 410 ในพื้นที่ หมู่ที่ 4 บ้านบันนังกูแว อำเภอบันนังสตา จังหวัดยะลา โดยภายหลังเกิดเหตุ เจ้าหน้าที่ได้ควบคุมพื้นที่และปิดกั้นที่เกิดเหตุ ตรวจสอบหาวัตถุพยานและรวบรวมหลักฐานต่าง ๆ จากนั้นเจ้าหน้าที่ได้ดำเนินการติดตามและขยายผลจนกระทั่งนำไปสู่การจับกุมตัวคนร้ายมาดำเนินคดีตามกฎหมายได้ในที่สุด

          โดยเมื่อวันที่ 30 สิงหาคม 2567 ศาลจังหวัดยะลา (ชั้นต้น)  พิพากษา “ประหารชีวิต นาย ซามีม (สงวนนามสกุล) จำเลย” ความผิดฐาน ฆ่าผู้อื่น โดยไตร่ตรองฯ  พ.ร.บ.อาวุธปืนและวัตถุระเบิดฯ แต่จำเลยให้การสารภาพตามข้อหาความผิดตามที่โจทก์ฟ้อง ว่าจำเลยได้ร่วมกันก่อเหตุในคดีนี้จริง ศาลจึงลดโทษ กึ่งหนึ่ง เนื่องจากจำเลยให้การรับสารภาพ คงเหลือ “จำคุกตลอดชีวิต” (อ.363/67)

💢 Mahkamah Tinggi Yala menjatuhkan hukuman “penjara seumur hidup” kepada suspek yang menembak keluarga anggota Pasukan Pertahanan Awam Hakim, di kawasan Kampung Bunnan Ngul, Bandar Bunnangsta, pada tahun 2557.

          Kejadian berlaku pada 20 April 2557, di mana penjenayah menembak ahli keluarga anggota Pasukan Pertahanan Awam Hakim Daraesah, menyebabkan 3 orang maut dan 1 cedera. Kejadian ini berlaku di Jalan Raya 410, Kampung Bunnan Ngul, Daerah Bunnangsta, Yala. Selepas kejadian, pihak berkuasa mengawal kawasan dan menutup tempat kejadian, menyiasat bukti dan mengumpul segala bukti yang diperlukan. Pihak berkuasa kemudian menjalankan operasi susulan dan berjaya menangkap suspek untuk didakwa di mahkamah.

          Pada 30 Ogos 2567, Mahkamah Yala (peringkat pertama) menjatuhkan hukuman “hukuman mati” kepada encik Samim (nama dirahsiakan) yang disabitkan atas kesalahan membunuh orang lain dengan niat dan melanggar Akta Senjata Api dan Bahan Letupan. Walau bagaimanapun, kerana tertuduh mengaku bersalah, mahkamah mengurangkan hukuman kepada separuh dan menjatuhkan hukuman “penjara seumur hidup” (Kes A.363/67).

          Yala Court of First Instance sentences “life imprisonment” to the gunman who shot the family of Volunteer Defense Corps (VDC) Hakim Daraseh in Bunnan Ngul area, Bannangsta district, in 2014.

          The incident occurred on April 20, 2014, when an assailant shot members of the family of Hakim Daraseh, a member of the Volunteer Defense Corps, killing 3 people and injuring 1. The shooting took place on Highway 410, in Village 4, Bunnan Ngul, Bannangsta District, Yala Province. After the incident, authorities took control of the area, cordoned off the scene, and collected evidence. They followed up and expanded the investigation, eventually leading to the arrest of the suspect and legal proceedings.

          On August 30, 2024, the Yala Provincial Court (first instance) sentenced “Mr. Samim (name withheld), the defendant,” to “death” for the crime of murder with premeditation under the Firearms and Explosives Act. However, the defendant confessed to the charges as alleged by the prosecution, admitting participation in the crime. Therefore, the court reduced the sentence by half due to the confession, and the final sentence was “life imprisonment” (Case A.363/67).
