ศาลฎีกาพิพากษา จำคุกตลอดชีวิต คนร้ายลอบยิงเจ้าหน้าที่ทหารพรานและประชาชนในพื้นที่ ต.ตาเซะ อ.เมือง จ.ยะลา 

          จากเหตุการณ์เมื่อช่วงเย็นของวันที่ 7 มีนาคม 2557 ได้เกิดเหตุคนร้ายใช้อาวุธปืนลอบยิงเจ้าหน้าที่ทหารพรานเสียชีวิตในพื้นที่ บ้านทุ่งคอก หมู่ที่ 3 ตำบลตาเซะ อำเภอเมือง จังหวัดยะลา รวมทั้งมีสุภาพสตรีได้รับบาดเจ็บสาหัสอีกหนึ่งราย ผู้เสียชีวิตคือ สิบโท จิรพันธ์ ปราบณรงค์ อายุ 24 ปี สังกัดหน่วยเฉพาะกิจกรมทหารพรานที่ 48 ขณะเกิดเหตุเดินทางกลับมาเยี่ยมบ้านและได้เดินทางซื้อของกับแฟนสาว ระหว่างขากลับคนร้ายไม่ต่ำกว่า 2 คน อาศัยจังหวะเผลอลอบยิง สิบโท จิรพันธ์ฯ จากด้านหลัง ทำให้เสียชีวิตในที่เกิดเหตุทันที ขณะเดียวกันแฟนสาวของผู้เสียชีวิต ถูกกระสุนปืนยิงเข้าที่หน้าท้องได้รับบาดเจ็บสาหัส และถูกนำตัวส่งโรงพยาบาลยะลา ภายหลังเกิดเหตุ หน่วยงานความมั่นคงได้เข้าตรวจสอบพื้นที่ เก็บรวบรวมวัตถุพยานและหลักฐานต่างๆ โดยรอบและเร่งติดตามเบาะแสของคนร้ายจากกล้องวงจรปิดและพยานในที่เกิด จนกระทั่งสามารถนำไปสู่การจับกุมตัวคนร้ายได้ และส่งตัวเข้าสู่กระบวนการยุติธรรมต่อไป

          กระทั่งเมื่อวันที่ 15 มีนาคม 2566 ศาลจังหวัดยะลา (ชั้นต้น) พิพากษา “ประหารชีวิต” นายกูอาสมัน (สงวนนามสกุล) จำเลย ความผิดฐาน ก่อการร้าย อั้งยี่ ซ่องโจร ฆ่าผู้อื่นโดยไตร่ตรองฯ พ.ร.บ. อาวุธปืนและวัตถุระเบิดฯ เนื่องจากศาลเชื่อว่าจำเลยคือคนร้ายที่กระทำความผิดจริงตามที่โจทก์ฟ้อง (ขังจำเลยระหว่างอุทธรณ์ อ.341/65)

          ต่อมาเมื่อวันที่ 28 พฤศจิกายน 2566 ศาลอุทธรณ์ฯ พิพากษายืนตามศาลชั้นต้น “ประหารชีวิต” นายกูอาสมัน (สงวนนามสกุล) จำเลย ความผิดฐาน ก่อการร้าย อั้งยี่ ซ่องโจร ฆ่าผู้อื่นโดยไตร่ตรองฯ พ.ร.บ. อาวุธปืน และวัตถุระเบิดฯ เนื่องจากผู้เสียหายยืนยันมาตลอดว่าสามารถจดจำใบหน้าจำเลยได้ ทั้งสามารถยืนยันภาพถ่ายของจำเลยได้จากการดูภาพบุคคลจำนวนมาก ศาลจึงเชื่อว่าจำเลยคือคนร้ายที่กระทำความผิดจริงตามที่โจทก์ฟ้อง (ขังจำเลยระหว่างอุทธรณ์ อ.341/65)

          และล่าสุดวันที่ 1 กรกฎาคม 2568 ศาลฎีกาพิพากษา “จำคุกตลอดชีวิต” นายกูอาสมัน (สงวนนามสกุล) จำเลย เนื่องจากพยานหลักฐานที่โจทก์นำสืบนั้น มีผู้เสียหายซึ่งเบิกความยืนยันมาโดยตลอดว่าสามารถจดจำใบหน้าของจำเลยได้ ซึ่งต่อมาพนักงานสอบสวนนำภาพผู้ต้องสงสัยที่อยู่ในขบวนการก่อความไม่สงบให้ผู้เสียหายดู โดยผู้เสียหายสามารถยืนยันภาพถ่ายของจำเลยได้จากการดูภาพของบุคคลจำนวนมาก มีเหตุผลน่าเชื่อว่าผู้เสียหายจดจำจำเลยได้จริง ศาลจึงเชื่อว่าจำเลยคือผู้ที่กระทำผิดในคดีนี้ คดีถึงที่สุด (ขังจำเลยตามคำพิพากษา อ.341/65)

          Mahkamah Agung Menjatuhkan Hukuman Penjara Sepanjang Hayat terhadap penjenayah yang menembak anggota tentera dan orang awam di Kampung Tase, Daerah Muang, Wilayah Yala.

          Kejadian berlaku pada petang 7 Mac 2014, apabila penjenayah bersenjata melepaskan tembakan dan membunuh anggota tentera di Kampung Thung Khok, Moo 3, Tase Subdistrict, Daerah Muang, Wilayah Yala. Seorang wanita turut cedera parah dalam insiden tersebut.

Mangsa yang terbunuh ialah Sertu Jiraphan Prabnarong, 24 tahun, dari Unit Tugas Khas Batalion Tentera Renjer ke-48. Ketika kejadian, beliau pulang ke kampung dan keluar membeli-belah bersama teman wanitanya. Dalam perjalanan pulang, dua orang penjenayah mengambil kesempatan dan menembak mangsa dari arah belakang menyebabkan beliau meninggal dunia di tempat kejadian. Teman wanitanya pula ditembak di perut dan cedera parah sebelum dihantar ke Hospital Yala.

Pihak keselamatan segera menyiasat kawasan kejadian, mengumpul bukti dan mengejar suspek berdasarkan rakaman CCTV dan saksi. Siasatan ini akhirnya membawa kepada penangkapan suspek dan tindakan undang-undang diambil.

          Pada 15 Mac 2023, Mahkamah Wilayah Yala (peringkat pertama) menjatuhkan hukuman mati terhadap Encik Ku Asman (nama keluarga dirahsiakan), tertuduh atas kesalahan keganasan, menyertai kumpulan jenayah, pembunuhan dengan niat, dan melanggar Akta Senjata Api dan Bahan Letupan. Mahkamah percaya tertuduh benar-benar melakukan kesalahan seperti yang dituduh. (Tertuduh ditahan sepanjang proses rayuan – No. Kes A.341/65)

          Pada 28 November 2023, Mahkamah Rayuan mengesahkan keputusan mahkamah peringkat pertama dan mengekalkan hukuman mati terhadap Encik Ku Asman. Mahkamah percaya keterangan mangsa yang mengenal pasti wajah tertuduh daripada sejumlah besar gambar adalah sah dan boleh dipercayai. (Tertuduh terus ditahan semasa proses rayuan – No. Kes A.341/65)

          Terakhir, pada 1 Julai 2025, Mahkamah Agung menjatuhkan hukuman penjara seumur hidup terhadap Encik Ku Asman. Walaupun mangsa dapat mengenal pasti wajah tertuduh, mahkamah mengambil kira semua bukti dan memutuskan hukuman penjara sepanjang hayat lebih sesuai. Kes kini telah mencapai keputusan muktamad.           Supreme Court Sentences Gunman to Life Imprisonment for the deadly ambush on a ranger officer and civilians in Tase Subdistrict, Mueang District, Yala Province.

          On the evening of March 7, 2014, a gunman opened fire and killed a ranger officer in Ban Thung Khok, Moo 3, Tase Subdistrict, Mueang District, Yala Province. A woman was also severely injured.

The deceased was Sergeant Jiraphan Prabnarong, aged 24, a member of Ranger Task Force Unit 48. At the time of the incident, he was returning home to visit family and was out shopping with his girlfriend. On their way back, at least two assailants ambushed and shot Sergeant Jiraphan from behind, killing him instantly at the scene. His girlfriend was shot in the abdomen and seriously injured. She was rushed to Yala Hospital.

Following the incident, security forces investigated the area, collected evidence, and used CCTV footage and witness testimonies to track down the suspects. This eventually led to the arrest of the perpetrator, who was brought to justice.

          On March 15, 2023, the Yala Provincial Court (First Instance) sentenced Mr. Ku Asman (surname withheld) to death for the crimes of terrorism, criminal association, premeditated murder, and violations of the Firearms and Explosives Act. The court was convinced that the defendant was indeed the perpetrator, as alleged by the prosecution. (The defendant was detained during the appeal process, Case No. A.341/65)

          On November 28, 2023, the Court of Appeal upheld the lower court’s verdict and reaffirmed the death sentence for Mr. Ku Asman. The victim consistently testified that he could recognize the defendant’s face and successfully identified him from a large number of photographs. The court believed the victim’s identification was credible and ruled the defendant was indeed the perpetrator. (The defendant remained in custody during appeal, Case No. A.341/65)

          Most recently, on July 1, 2025, the Supreme Court commuted the sentence and ruled life imprisonment for Mr. Ku Asman. The court found that the prosecution’s evidence—especially the consistent and detailed testimony from the victim, who identified the defendant from a set of photos of suspected insurgents—was credible. The court therefore concluded that the defendant was the perpetrator. The case is now final. (The defendant will remain imprisoned as per final ruling, Case No. A.341/65)
