กลับคำพิพากษาศาลชั้นต้นจาก “ยกฟ้อง” เป็น “ประหารชีวิต” แต่คำให้การเป็นประโยชน์ต่อการพิจารณา จึงลดโทษเป็น “จำคุกตลอดชีวิต”

เหตุคนร้ายลอบยิงอาสาสมัครทหารพราน มูฮามะสอบรี ซาเราะ สังกัดหน่วยเฉพาะกิจกรมทหารพรานที่ 42 เสียชีวิต บริเวณตลาดนัดบ้านบือแนราเมาะ หมู่ที่ 4 ตำบลมะนังดาลำ อำเภอสายบุรี จังหวัดปัตตานี เมื่อวันที่ 14 กุมภาพันธ์ 2557 ที่ผ่านมา และเมื่อวันที่ 7 กันยายน 2565 ชุดปฏิบัติการพิเศษร่วมปัตตานี สนธิกำลังเข้าบังคับใช้กฎหมาย หลังได้รับแจ้งข้อมูลข่าวสารพบเห็น นายรออีซะ (สงวนนามสกุล) ซึ่งมีหมายจับตามประมวลกฎหมายวิธีพิจารณาความอาญา จำนวน 4 หมาย ได้เข้ามาหลบซ่อนตัวในพื้นที่ หมู่ที่ 5 ตำบลกะรุบี อำเภอกะพ้อ จังหวัดปัตตานี ชุดปฏิบัติการพิเศษร่วมปัตตานีจึงเข้าบังคับใช้กฎหมาย จนสามารถควบคุมตัว นายรออีซะ (สงวนนามสกุล) ได้ ซึ่งนายรออีซะ (สงวนนามสกุล) อยู่ในหมายจับตามประมวลกฎหมายวิธีพิจารณาความอาญา เหตุลอบยิงอาสาสมัครทหารพราน มูฮามะสอบรี  ซาเราะ สังกัดหน่วยเฉพาะกิจกรมทหารพรานที่ 42 เสียชีวิต บริเวณตลาดนัดบ้านบือแนราเมาะ อยู่ด้วย

และเมื่อวันที่ 17 สิงหาคม 2566 ศาลจังหวัดปัตตานี (ชั้นต้น) พิพากษา “ยกฟ้อง” นายรออีซะ (สงวนนามสกุล) จำเลย เนื่องจากโจทก์มีเพียงผลดำเนินกรรมวิธีซักถามของจำเลยเท่านั้น ยังไม่เพียงพอที่เชื่อว่าจำเลยเป็นกระทำผิดตามฟ้อง ทั้งไม่สามารถพิสูจน์ได้ว่าจำเลยคือ คนร้ายที่ยิงผู้เสียหายในคดีนี้ ศาลจึงต้องยกประโยชน์แห่งความสงสัยให้เป็นคุณแก่จำเลย

ต่อมาเมื่อวันที่ 19 มิถุนายน 2567 ศาลจังหวัดปัตตานีอ่านคำพิพากษา ศาลอุทธรณ์ ภาค 9  พิพากษากลับคำพิพากษาศาลชั้นต้น จาก “ยกฟ้อง” ให้ลงโทษ “ประหารชีวิต” นายรออีซะ (สงวนนามสกุล) จำเลย ในความผิดฐานร่วมกันฆ่าผู้อื่นโดยไตร่ตรองไว้ก่อน เนื่องจากศาลอุทธรณ์ฯ เชื่อว่าจำเลย คือ คนร้ายที่กระทำความผิดในคดีนี้ จำเลยให้การเป็นประโยชน์ต่อการพิจารณา จึงลดโทษ 1 ใน 3 คงเหลือ จำคุกตลอดชีวิต และขังจำเลยระหว่างฎีกา

💢 Keputusan Mahkamah Tinggi yang mengubah keputusan Mahkamah Rendah dari “Pembebasan” kepada “Hukuman Mati”. Walau bagaimanapun, kenyataan tertuduh memberi manfaat dalam pertimbangan, maka hukuman dikurangkan kepada “Penjara Seumur Hidup”.

⚖ Kejadian melibatkan penyerang yang menembak mati anggota sukarelawan tentera, Mohama Sorri Saerah, yang bertugas dengan Unit Tugas Khas Batalion Tentera 42, di Pasar Tani Bue Nara Meah, Kampung 4, Mukim Manangdalam, Daerah Saiburi, Pattani pada 14 Februari 2557. Pada 7 September 2565, pasukan operasi khas bersama Pattani telah berjaya menahan Encik Roiza (nama disembunyikan) yang mempunyai 4 waran tangkap dalam kawasan Kampung 5, Mukim Karubi, Daerah Kapho, Pattani, selepas menerima maklumat daripada sumber yang sah. Encik Roiza (nama disembunyikan) berhubung dengan waran tangkap yang berkaitan dengan kes tembakan yang mengorbankan Mohama Sorri Saerah.

📌 Pada 17 Ogos 2566, Mahkamah Pattani (Mahkamah Pertama) memutuskan “Pembebasan” terhadap tertuduh, Encik Roiza (nama disembunyikan), kerana pihak pendakwaan hanya mempunyai pengakuan tertuduh yang tidak mencukupi untuk membuktikan tertuduh adalah orang yang melakukan jenayah tersebut. Mahkamah mendapati tidak ada bukti yang mencukupi untuk meyakinkan bahawa tertuduh adalah penyerang yang menembak mangsa dalam kes ini. Oleh itu, Mahkamah memberi manfaat atas keraguan kepada tertuduh.

📍 Kemudian, pada 19 Jun 2567, Mahkamah Rayuan Negeri 9 Pattani telah mengubah keputusan Mahkamah Pertama dari “Pembebasan” kepada “Hukuman Mati” terhadap Encik Roiza (nama disembunyikan) kerana didapati bersalah atas kesalahan membunuh orang lain dengan niat jahat. Mahkamah Rayuan yakin bahawa tertuduh adalah penyerang dalam kes ini. Walaupun begitu, kenyataan tertuduh dianggap memberi manfaat, dan hukuman dikurangkan sebanyak 1/3, menjadikan hukuman akhirnya adalah Penjara Seumur Hidup. Tertuduh juga akan dipenjarakan sementara menunggu rayuan.

💢 The appellate court reversed the lower court’s verdict from “Acquittal” to “Death Penalty,” but since the defendant’s testimony was beneficial to the court’s consideration, the sentence was reduced to “Life Imprisonment.”

⚖ The incident involved the shooting death of volunteer ranger, Mohama Sorri Saerah, assigned to the 42nd Battalion Ranger Task Force, at the Bue Nara Meah Market, Village 4, Manangdalam Subdistrict, Saiburi District, Pattani on February 14, 2014. On September 7, 2022, the Special Operations Unit of Pattani, after receiving intelligence, moved in to enforce the law upon locating Mr. Roiza (name withheld), who had four arrest warrants under the Criminal Procedure Code, hiding in the area of Village 5, Karubi Subdistrict, Kapho District, Pattani. The Special Operations Unit successfully arrested Mr. Roiza (name withheld), who was wanted for the shooting death of Mohama Sorri Saerah.

📌 On August 17, 2023, the Pattani Provincial Court (First Instance) acquitted Mr. Roiza (name withheld), the defendant, as the prosecution’s evidence, which was based solely on the defendant’s interrogation process, was insufficient to convince the court that the defendant committed the crime. Furthermore, there was no evidence to prove that the defendant was the perpetrator who shot the victim in this case. Therefore, the court gave the benefit of the doubt in favor of the defendant.

📍 Later, on June 19, 2024, the Pattani Provincial Court read the judgment of the 9th Regional Court of Appeal, which reversed the lower court’s judgment from “Acquittal” to a “Death Penalty” for Mr. Roiza (name withheld) on charges of premeditated murder. The appellate court was convinced that the defendant was the perpetrator of the crime. As the defendant’s testimony was beneficial, the sentence was reduced by one-third, leaving him with a sentence of “Life Imprisonment,” and he will be held in custody pending further appeal.
